Claims and Disputes Resolution Services

QPMC offers a vast range of professional services in the context of Contracts, Claims, and Disputes Resolution. Those services were designed to fit into a large variety of organizational structures, and can be tailored further as needed based on the requirements and budget of our Clients.

Most of our services listed below can be offered and applied on either the Company level and/or any Project level depending on the necessity.

  1. Claims Management
  • Design, develop and/or physically implement a robust change management strategy & procedures, and/or support in the establishment of a full change management department.
  • Support in the development and/or monitoring of the project’s claims strategy with a bullet-proof claims risk assessment and containment plan.
  • Review the nature and details of any contractual dispute, then either provide professional support, develop claims structure, or prepare claims merit reports.
  • In addition, and most importantly, support and/or develop a wide range of construction/commercial claims from our Client’s perspective.
  1. Delay Analysis & Expert Reports
  • Perform delay analysis, and develop corresponding expert reports from a third-party perspective.
  • Review commercial records and develop quantum reports for prolongation cost claims, disruption claims, escalation of rates claims, loss of profit claims, or any monetary claims for damages.
  1. Mediation & Adjudication
  • In cases where project stakeholders are interested to develop a positive mechanism for disputes resolution, QPMC can provide any necessary mediation services. We can review the disputes details, communicate/negotiate with the project teams, and provide 3rd party resolution reports for the parties’ consideration and final decision.
  • Disputes Resolution Boards creation is one of the requirements of FIDIC contracts, however, they are not widely implemented within the region’s construction projects despite their positive prospects in acquiring quick and efficient disputes resolutions. We can offer support to the project owners or contractors to assign an experienced and certified Adjudicator to implement the DRB.
  1. Arbitration Support
  • Provide technical and professional support to claimants to organize their project’s technical and financial records in preparation for arbitration.
  • Support financially distressed claimants to build their case, and utilize law firms and funders.
  1. Contracts Admin & Support Services
  • Our services in contracts management can start as early as during the tendering stage, where we can assess the Contract documents and provide a report on the contractual risks and the means for their incorporation/containment in the offer.
  • Provide any required contractual support, starting from the review or development of specific or important documents/correspondences, up to the full contract administration of the project.
